2. Promotion Period
The Contest promotion begins January 1, 2008 at 12:00 am Central Standard Time, and ends July 31, 2008 at 12 midnight, Central Standard Time ("Promotion Period"). All entries must be received during the Promotion Period.
3. How to Enter
To enter, complete the Entry Form, located at www.Cambriausa.com/lifestylescontest. Unlimited amount of entries allowed. Not responsible for late, lost, stolen, misdirected, misplaced, illegible, mutilated, damaged, incomplete or postage due mail in entries. Proof of sending will not be deemed to be proof of receipt by Sponsor. Entries become the property of Sponsor and will not be returned. Sponsor is not responsible for any computer, telephone or technical malfunctions that may occur, for any incorrect or inaccurate information, whether caused by equipment associated with or utilized in the Contest, or any technical error which may occur in the processing of submissions in the Contest, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries or for any problems, failures or technical malfunction of any telephone network or lines or computer systems. If, for any reason, the Contest is not capable or running as planned, due to tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest in whole or in part and randomly select a winner from among all eligible entries legitimately received prior to the cancellation, termination or modification.
All photos submitted must be the original creation of the entrant, and entrant must own all rights, title and interest in all, aspects of the photo. By submitting an entry, entrant represents and warrants that the photo submitted is his/her original creation in accordance with these Official Rules, has not been copied on whole or in part from any other work, does not violate or infringe any copyright, trademark, privacy, publicity or other proprietary right of any person or entity, is his/her sole and exclusive property (if the photo was taken by some other person, he/she warrants and represents that he/she has obtained all rights and permission from such person so that he/she owns all rights, title and interest in all aspects of the photo(s) and his/her entry), if applicable, that each person appearing in the photo has consented in writing to its submission in the Contest and to the uses stated in these Official Rules. By submitting a photo, entrant further represents and warrants that he/she has all necessary rights to grant Sponsor the publication and use rights set forth below. As determined by Sponsor in its sole discretion, photos that include material unfit for publication, objectionable material, material that defames or invades the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any third party's personal or proprietary rights will be disqualified. Photos which are otherwise in violation of these Official Rules as determined by Sponsor at its sole discretion will not be posted. Proof of delivery or receipt of entry will not be deemed by Sponsor as proof of entry into this Contest. By entering this Contest, entrant grants Sponsor the right (a) to publish any and all photos in any present or future media in which it is or may be published, including without limitation, electronic databases, or other websites owned, operated by or affiliated with Sponsor, without further compensation; and (b) to modify, edit, adapt, and electronically alter photos herein, it is not obligated to, nor does it represent or warrant that any photos submitted by entrant will be published on the web site or otherwise, or that publication will free of technical errors, problems or compatibility issues and Sponsor shall have no liability related thereto.
4. Eligibility
Contest is open only to legal residents of the United States and Canada who are 18 years of age or older. Void where prohibited and subject to all laws. Employees, directors and officers of Sponsor, advertising and promotion agencies and others involved in the creation, production or execution of this Contest, and members of their respective immediate family (spouses, parents, siblings and children and their spouses) and households (whether or not related) are not eligible.
5. Description of Prizes
(1) Grand Prize winner will be awarded $1,000. in American Express Gift Cards.
(12) Best Design winners will each be awarded $500 in American Express Gift Cards.
Sponsor and its agents make no warranties, representations or guarantees relative to any prize, and disclaim all liability for the provision, quality or nature of any third party services provided to winner. Odds of winning depend on total number of eligible entries received.
6. Winner Selection/Notification/Releases
Entries will be judged by Sponsor based on professional representation, quality of fabrication, styling and photography, and the innovative use of Cambria. Winners will be notified on or about August 1st, 2008. Sponsor's decisions regarding all Contest matters are final. Winners will be notified by phone or email and will be required to complete, sign and return within a specified time an Affidavit of Eligibility, a Liability Release and, except where prohibited, a Publicity Release. If required documents are not timely returned or if prize notification is returned as undeliverable, prize will be forfeited and awarded to a randomly selected alternate. By participating, entrants agree to these Official Rules and to the decisions of the Sponsor, which shall be final in all respects, including (without limitation) all decisions regarding eligibility, compliance with these rules, the selection of the winner, and the awarding of prizes; to release and hold Sponsor, advertising and promotion agencies and their respective directors, agents and employees harmless from all liability, loss, personal injury or death, or damage to reputation or of any kind attributable in whole or in part, directly or indirectly, to their participation in the Contest or their acceptance and/or use of a prize to or from or participation in any prize-related activity; and if a winner, to Sponsor's unrestricted use in all media of winner's name, voice, likeness and state of residence for advertising and promotional purposes, without additional compensation, credit, or right of review or approval, except where prohibited.
Any promotion materials including the offer or these Official Rules, which contain production, printing or typographical errors, or are obtained outside authorized or legitimate channels are void; and Sponsor's liability, if any, is limited to the replacement of such materials. Recipients of such materials release Sponsor, its parent, affiliated and subsidiary companies, the judging organization and their respective officers, directors, employees and agents from any and all losses, claims or damages that may result therefrom.
7. Arbitration/Choice Of Law
Except where prohibited, participants agree that any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by participant with regard to this Contest, but in no event attorneys' fees, punitive, incidental, consequential or other damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor and/or Sponsor's agencies in connection with the Contest shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules or provisions (whether of Minnesota or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Minnesota. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision so long as the general intent of these rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
